A divorce case may be filed in Michigan if either spouse has been a resident of the state for at least 6 months. Divorce cases are filed in Circuit Court for the county in which either party resides. One must be a resident of a county for at least 10 days in order to file in the County. This can often be significant when the parties reside in different households or when one party intends to move from the marital home. It is important to speak with a lawyer about these issues and how they may impact your case prior to filing for divorce.

A divorce case involving minor children may not be completed in less than 6 months, except where there exists a “compelling necessity” to do so. As with many aspects of your divorce case, judges opinions vary when it comes to what constitutes a “compelling necessity”. Divorces without minor children may be finalized in as little as 60 days.

 

 

Amicable Divorce

Divorce cases need not be high conflict. Many divorce cases can be resolved amicably, which will reduce the cost and length of time the divorce takes. Where children are involved, it will also promote a strong co-parenting relationship between the parents in the future.

The key is to ensure that quality is not being sacrificed for expediency. A full disclosure of assets and liabilities is key.
